About the Book

Here's a book that exposes the myths about Oregon's "land use planning" (regulatory) system, and explains why major reforms are needed and why other states should not use it as a model. It also addresses unfair and excessive wetlands, endangered species and forest practice regulations.

The land use regulatory system needlessly crams almost all people and development on less than 2% of the land in the state, unfairly strips landowners of their rights to use their land, blocks development and escalates its cost, makes housing unaffordable, misdirects resources, hurts the economy, intentionally increases traffi c congestion, impairs quality of life, and reduces tax revenues needed for schools and public services.

The book provides relevant historical background - how the regulatory system evolved and where it went wrong, It also exposes the utter failure of the courts and the legislature to provide protection for property rights, one of our most basic civil rights.



About the Author

Bill Moshofsky is uniquely qualifi ed to write this book. He was involved in the 1973 legislative process when Senate Bill 100 (the "land use planning" law) was enacted, and in its subsequent implementation, including serving as a member of a legislative interim committee dealing with some of the problems with the law. For the past 15 years he has worked on land use regulatory matters as a nearly full time volunteer with Oregonians In Action organizations. They are statewide nonprofi t corporations fi ghting for sensible, fair and fl exible land use regulations and protection for property rights on all fronts - in the legislature, in the courts, with state agencies, before local governments, in the media, and at the ballot box. He is President of Oregonians In Action Legal Center and Oregonians In Action Education Center.

Bill also dealt with land use concerns in Oregon and across the country as a lawyer in Portland and Klamath Falls for 10 years and as an attorney and executive for 23 years with Georgia-Pacifi c Corporation, which had extensive land holdings. He had responsibility for the corporation's government affairs, environmental matters, and transportation.
